IRD Standard Product Warranty Statement
International Road Dynamics Inc. (IRD) warrants all IRD manufactured materials and equipment for a period of one (1) year from the original date of delivery, unless otherwise agreed in writing or specified differently within this statement. This warranty covers the manufacture of the equipment and includes manufacturer’s workmanship, material defects, and assembly, but does not include re-installation. This warranty does not cover physical damage caused by improper installation by others, vandalism, lightning, flood, fire, accident, damage by terrorism, war, or Acts of God. Unauthorized third-party connections to IRD systems may void any IRD warranty, whether offered or implied.
The warranty on OEM equipment which IRD resells, whether as standalone equipment or as part of an IRD integrated system, is as provided by the OEM manufacturer.
Warranty for grouts, epoxies and other chemically based materials are conditional upon proper storage, road suitability, and usage prior to the manufacturer’s expiry date provided on the packaging.
Customers must inspect all IRD delivered materials and equipment on receipt and must notify IRD within ten (10) calendar days of equipment delivery of any material damage, defects or non-conforming items. In the absence of such notification, all delivered materials and equipment shall be deemed by IRD to have been accepted by the Customer as received.
Materials and equipment that fail during the warranty period may be repaired or replaced at the discretion of IRD. All repairs shall be performed by IRD authorized personnel unless otherwise agreed on a case by case basis. Customers requesting warranty repair or replacement shall return the original materials or equipment properly packaged according to IRD RMA guidelines.
With respect to licensed software, at time of delivery to the Licensee and for a period of twelve (12) months thereafter, IRD warrants (i) that the Licensed Software will conform in all material respects to the functional capacities described in the Documentation when used as instructed and on the designated computer and operating system; (ii) that Documentation contains necessary information to use the Software; and (iii) that the media on which the Software is supplied shall be free from defects in material and workmanship. In any event, IRD makes no representation or warranty, express or implied, that the operation of the Software will be uninterrupted or error free, that all non-conformities can or will be corrected, or that the Software will meet or satisfy its intended use, requirements, or expectations.
IRD shall not under any circumstances be liable for any special, incidental, indirect or consequential damage, including without limitation, damages from the use or malfunction of the product, loss of profits or revenues or cost of replacement goods, whether IRD has been informed or not in advance of the possibility of such damages.
Some products may have separate and/or specific warranties in addition to the general terms of this warranty.
